Hereafter Mr President Limo Hire shall be known as the company and the person named overleaf, and or the person signing the confirmation shall be known as the HIRER. It will be deemed that the hirer accepts FULL responsibility by himself/herself for every person in his/her party and fully agrees to the conditions of hire as follows.Your booking starts when the limo/hummer arrives at the pickup, and includes time taken for photographs ect. Please allow enough time to complete your transfers when booking the limo/hummer. If you are unsure please contact us. 1. All bookings must be confirmed within 48 hours with a NON REFUNDABLE deposit of 25% min of total hire charge before it is accepted as a positive booking. Balance is to be paid14 days prior to hire date (wedding bookings 2’1 days prior) or unless prearranged with the company.2. All bookings made with the company require the hirer to provide us with a valid credit card number prior to hire date as a security against any damage to the vehicle or loss sustained by the company during hire period. ID ( eg Drivers Licence ) will be required to identify the card holder.3. As far as possible the hirer should try to maintain the time frame for which the vehicle is reserved. Reasonable time will be allowed for delays for pickups and return collection times. Up to 15 minutes after the agreed times will be free. Thereafter a fee may be charged at increments of 15 min as per agreed hourly rate. The chauffeur will make every attempt to contact the hirer on phone numbers provided to avoid the likelihood of this occurring. If however after all efforts have been made to contact hirer and delay becomes unreasonable we reserve the right to cancel arrangement and depart from pick up area with no refund given. In the event that the time or location of the hire is changed prior to the hire date or at the time of pick up, the company reserves the right to make any additional charges if required.4. Time permitting, the chauffeur may be willing to collect or drop off additional passengers from alternative locations subject to the maximum capacity of the vehicle. Any extra request or alterations to the booking ( i.e. additional pick up or chop off points, change of venue causing extra mileage or time ) not made at time, of booking / confirmation cannot necessarily be entertained, although every effort will be made to meet these requirements and will be at the discretion of chauffeur to ensure it does not conflict with other commitments. Request for extension of hire time during hire period can be made to chauffeur an extra cost will be charged in increments of ’15 min as per standard hourly rates and will be subject to vehicle’s other commitments. Extension of time charges must be paid for at time to chauffeur. Any disparaging reviews that are vindictive due to payment disputes will further result in $1000/day charged to the credit card and is non refundable even if the review is removed 5. The company is not responsible for any delays caused by adverse weather, road conditions, roars works, traffic and any other conditions out of our control.6. Whilst every effort is afforded to the service ability of the vehicles, the company accepts no responsibility for mechanical, electrical or material breakdown how ever caused. In this unlikely event, every effort will be made for the immediate repair to the vehicle so that the journey can continue or the hirer will be transferred to another vehicle/s and any extra cost Incurred will be bourne by the company or partial refund given which shall be communicated directly with the hirer. In the event of a breakdown or accident to the vehicle booked prior to the (late of hire every effort will be made to supply a similar or alternative vehicle/s at the company’s discretion.7. Stretched Limousines are limited access vehicles. Chauffeurs reserve the tight to deny access to a venue that may put the vehicle or its patrons in an unsafe situation. The company accepts no responsibility for restricted access at any location and are not liable for delays caused by this. Unless otherwise entrusted by hirer and confirmed by the company. Routes travelled will be entirely at the discretion of the chauffeur in accordance with road traffic and weather conditions whether the route is the shortest or not. No allowance will be made to tho hirer on the grounds that the route is not actually the shortest.8. The law states that the wearing of fitted seat belts is compulsory at all times and all occupants are to adhere with this. The company’s chauffeur will be in a separate cabin to the passengers will be unable to monitor this adherence and are not there to police this. The chauffeur cannot give you authority not to wear a seat belt so please do not ask. Any fines incurred will be the responsibility of the individual.9. Luggage capacity in the vehicles is restrictive. The company will undertake to transport a reasonable quantity of accompanying luggage. If however, in the judgment of the chauffeur, volume or weight is excessive, the company reserves the right to refuse carriage of the said luggage. In addition the company does not assume any responsibility or liability for loss, stolen or damage to clients properly or luggage, however such loss or damage is caused.10. At no time will the company take responsibility for any personal belongings left behind in the vehicle. Clients are advised to check all personal belongings are in their possession when vacating the vehicle.11. All property including CD’S / DVD’S, lighting, glassware, bar equipment that is provided in the limousine for the pleasure of passengers remains the property of the company and the hirer accepts responsibility on behalf of the hirer’s party for any loss or damage of this property.12. The hirer expressly accepts that except in cases of emergencies, only the chauffeur may open and close vehicle doors, this is a safety precaution to minimise injury to passengers, accidents and damage to the vehicle. The company nor its chauffeurs will be held responsible for injury, accidents or damage caused as a consequence of the hirer or his/her party failing to adhere to this condition and the hirer accepts responsibility for any damage to the vehicle or third party as a result of hirer or hirers party failing to adhere to this condition.13. The consumption of food is not permitted in any of the vehicles unless specific agreement has been made with the company prior to the hire date.14. Where complementary drinks are supplied by the company, these must be consumed in the vehicle and must not be removed for any reason whatsoever. In the event that unopened drinks are removed, then the company may at its own discretion recover costs from the hirer. Hirers are not permitted to supply their own alcohol unless by prior arrangement with the company. Additional chinks are available from the company by request at a charge. Minors are not permitted to drink alcohol under any circumstances at any time in the limousines.15. The hirer accepts that the company adopts a strict NO SMOKING or VAPING policy in all of its vehicles and failure to adhere to this policy will result in the immediate termination of hire agreement without any refund. The company will not be held responsible for the use or transportation of any illegal substance or articles within the limousine. Failure to abide by this condition will result in immediate termination of hire agreement without refund.16.The company and or its chauffeur reserve the right to refuse entry to the vehicle to any person/persons they deem unfit for whatsoever reason. In this event no refund will be given.17. The chauffeur has the right to stop the vehicle and refuse to continue and cancel hire contract if any person/persons behave in an unruly, abusive or drunk manner which may be detrimental to other people or deemed to be mistreating the vehicle in any way whatsoever.The hirer is and will be helot responsible for the conduct and behaviour of their party.18. All vehicles are thoroughly cleaned and checked for damage before each hire The hirer shall be fully responsible and liable for any damage caused both inside and outside the vehicles by the hirer or any member of his/her party however caused. This includes incitement to ANY THIRD PARTY, which results in damage to the vehicle or its contents. The hirer agrees to be held liable for total retail cost of repairs as a consequence of any damage caused. In addition the hirer further agrees that the company may at its entire discretion determine the organisation that will complete the repairs. Furthermore the hirer shall be responsible for payment of a fixed rate, which shall be determined by the company, at its sole discretion for the period which the vehicle is out of commission as a consequence of the damage and repairs.19. PLEASE NOTE : A min charge of $250 for valet-service which may also include detailing will be charged to the hirer for any person being physically sick. The company reserves the right to make any additional charges and to set such charges against the hirer’s credit card in the event of this happening unless paid to chauffeur at time of rental in cash.20. The agreement to hire is between the e hirer and the company.21. The hirer must be at least 18 years old.22. In the event that the hirer is a company/ business then that company/business shall assume the responsibility of the hirer and be bound to advise the party or passengers these terms and conditions.23. The company may at its own discretion refuse any hire at any time without explanation or reason.24. The company reserves the right to change these terms and conditions without notice.25. Where damages incur a charge to be levied by the company notification will be sent to the Hirer, outlining the costs and methods of acceptable remuneration for these charges.26. Upon providing us with information, we may use this information to contact you via email or phone, so as to provide you with promotional offers and our newsletter. 26. All legal costs will be paid for by the client on an indemnity basis an deducted from the credit card.
These terms and conditions outline the agreement between You and Us in relation to Us providing you with goods and services.
TERMS AND CONDITIONS 1. DEFINITIONS
a. Booking means a reservation for chauffer driven limousine service for the Hire fee, on the Hire date and time and for the Hire Period agreed between You and Us. b. Hire Date means the date on which We agree to provide You with a chauffer driven limousine service. c. Hire Fee means the amount you agree to pay Us for providing You with a chauffer driven limousine service. The Hire Fee may be a fixed sum, hourly rate or combination of a fixed sum and hourly rate. d. Hire Period means the period during which We provide You with a chauffer driven limousine service but, in any case, not less than one (1) hour. e. Total Booking Cost means the total fee applicable to the Booking, including GST. f. Vehicle means the vehicle nominated by Us for the purpose of providing the chauffer driven limousine service. g. We, Us, Your Hummer means Mr President Limo Hire. h. You means the person or entity requesting the booking and, where the context requires, each of Your guests.2. BOOKING REQUESTS AND CONFIRMATIONS a. You may request a Booking from Us by email, by completing a form on our website or by telephone. b. Your Hummer will confirm Your Booking in writing by email within 24 hours of Your Booking being made.3. PAYMENT a. Upon You making a booking for a Hire Date, You must provide Us with your credit card details. b. You hereby authorise Us to deduct any charges payable under these Terms and Conditions from your nominated credit card, without deduction or further authorisation from You. c. We will add a surcharge of 2% of the Total Booking Cost for credit card payments. d. A Booking deposit of 30% of the Total Booking Cost is payable by You by credit card at the time of making the Booking. e. We will collect balance of the Total Booking Cost 7 days prior to the Hire Date. f. Should You make a Booking within inside of 14 days of the Hire Date, then full payment of the Total Booking Cost is required by You to Your Hummer to secure the Booking. g. When Your Hummer receives payment of the Booking Deposit or Total Booking Cost, such payment constitutes acknowledgement and acceptance of these Terms and Conditions by You.4. CANCELLATIONS AND REFUNDS a. The following costs are payable in respect of any cancellation of a Booking:Within 14 days of the Booking being confirmed: Cancellation fee of $150.00, to be deducted from the Booking depositAfter 14 days of the Booking being confirmed, but before 14 days prior to the Hire Date Forfeiture in full of the Booking deposit Within 14 days of the Hire Date Forfeiture of the Total Booking Costb. If You fail to be present at the agreed collection point for the commencement of the Hire Period, You will be deemed to have cancelled Your booking. c. You authorise Us to deduct the applicable above amounts from your nominated credit card as necessary pursuant to these Terms and Conditions.5. AMENDMENTS OR CHANGES TO HIRE PERIOD a. Any requests, changes or amendments to a Booking after a Booking has been confirmed, including requests, changes or amendments made on the Hire Date are subject to an amended booking fee of $25.00. b. The following events constitute a change or amendment to a Booking: i. Changes to date or time of the Hire Period; ii. Changes to the Vehicle used for the Hire Period; iii. Changes to the pick-up point and/or destination point or the duration of the Hire Period. Changes to the time of destination drop-off during the Hire Period.6. PICK -UP/ DROP OFF LOCATION a. We will contact You 24 hours prior to the commencement of the Hire Period to confirm the details of the pick-up location and time and the destination drop-off point and time. b. Your Hummer requests that You ensure you allow sufficient time to meet any personal time requirements you may have during the Hire Period. We shall not be liable for late arrival to your event in any way. c. Your Hummer will use its best endeavours to adhere to Your specified pick up and drop off locations and time. d. Your Hummer reserves the right to select the route travelled during the Hire Period, notwithstanding that the route may not be the shortest or quickest route to the drop off location. e. Given the lengths of the vehicles and limited access in some locations, We reserve the right to refuse to drive You to any location or by any route that may, in our opinion, put the Vehicle, You or third parties at risk of damage or injury.7. EXTENSION OF TIME a. You may extend the time of the Hire Period subject to any other Bookings and the duration of the time required, by agreement with our Driver. b. In the event that you are uncontactable during the Hire Period, the Driver may, at his discretion and availability, wait extra time for you to arrive for pick-up or drop-off. In this event, you will be charged for an Extension of Time plus an administrative fee in accordance with these Terms and Conditions. c. Extension of Time will be charged in 15 minute intervals at a rate of $100 per 15 minute interval/s. You agree to pay for the Extension of Time and the following payment method is available to You: i. You can pay cash to the Driver; or ii. You irrevocably authorise Your Hummer to charge the Extension of Time, in accordance with these terms and conditions from Your credit card provided to Your Hummer at the time of the Booking of the Hire Period.8. ADDITIONAL STOCK REQUESTS a. You may request Us to organise and include additional stock in the Vehicle for the Hire Period. b. All requests for additional stock must be made at least 7 days prior to the Hire Date. c. You are liable for any and all costs of purchasing any additional stock, at a surcharge of 10% over the cost price. d. We make no guarantee to provide any or all of the additional stock requested by You for the Hire Period.9. NO FOOD a. The consumption of food is strictly prohibited in the Vehicle, unless a specific agreement has been made at the time of Booking and is agreed to in writing. b. You acknowledge and agree that should food be consumed in the Vehicle without agreement, then Your Hummer reserves the right to charge a cleaning fee of $300.00.10. NO SMOKING a. You and all third parties are strictly prohibited from smoking within the Vehicle. b. Should any person smoke within the Vehicle, the cost of cleaning the interior of the Vehicle will be payable by You at a rate of $300.00 and the Hire Period will be terminated immediately, without refund of any part of the Total Booking Cost.11. CLEANING, BREAKAGES, AND DAMAGES a. You agree to pay to Us a Cleaning Fee of $300.00, where You, or any third party, soil, stain, or pollute the vehicle, including, but not limited to vomiting and spillage of food or beverages. b. You agree to pay for the replacement any of the following items supplied with the Vehicle should they be damaged, lost or removed from the vehicle during the Hire Period at the following costs: i. Glasses: $15.00 each; ii. Television Remote Controls: $100.00 each; iii. Alcoholic beverages: $20.00 per bottle. c. Should the Vehicle or items supplied with the Vehicle require any additional repair or replacement at completion of the Hire Period, as a result of any action by You or any third party, the cost of repair or replacement will be payable by You at such reasonable rates as calculated by Us. This includes, but is not limited to, damage to Vehicle seating, damage to carpeting, broken windows and damage to light fixtures. d. You shall be liable to Us for any lost revenue when the Vehicle is unable to be used to provide limousine services to other customers, including consequential damages suffered by Us relating to the cancellation of other bookings with Our customers.12. VEHICLE ACCIDENTS, BREAKDOWNS, AND MALFUNCTIONS a. You accept that Your Hummer, its officers, employees and affiliates, are a booking agent only for the owner or owners of the Vehicle and You agree not to take any action against Your Hummer for the result of any act or failure to act by the owners of the Vehicles or their employees, agents, representatives, or subcontractors including, but not limited to, any loss or expenses incurred by You should the Vehicle break down or be involved in an accident during the Hire Period. b. In the event of a traffic accident, mechanical breakdown, malfunctions, or circumstances beyond our control, including inclement weather or road closures, as a result of which We are unable to provide the service, Your Hummer will use its best endeavours to transport You and Your guests to Your destination. The mode of travel will be at Our sole discretion. c. In the event that an equivalent or alternative Vehicle, or alternate arrangements for the Hire Period cannot be made for the Hire Period, You are entitled to a refund of the Total Booking Cost.13. UNFORESEEN EVENTS OR CIRCUMSTANCES a. You acknowledge that from time to time and for reasons beyond Our control, the Vehicle booked for the Hire Period may be unavailable due to unforeseen events, circumstances, or any other reason. b. Should such as event occur, We will: i. Make contact with You and inform of such change prior to the start of the Hire Period, and; ii. We will use Our best endeavours to make arrangements for an equivalent or alternative vehicle to be made available for the Hire Period; and iii. In the event that an equivalent or alternative vehicle cannot be made available for the Hire Period, You will be entitled to a refund of the Total Booking Cost.14. BOOKING OF UNDERAGE EVENTS a. Should We receive or take a Booking for a debutante ball, school formal, children’s party, or any other booking of a similar purpose, You acknowledge and agree: i. No alcoholic beverages whatsoever may be consumed by You or any member of Your party, regardless of whether You or any member of Your party is over the age of 18; ii. We reserve the right to ask for an adult to accompany and ride in the Vehicle for the duration of the Hire Period; iii. We reserve the right to immediately terminate the Hire Period in the event of breach of this Clause and under such circumstances, the Total Booking Cost shall be forfeited.15. LOST PROPERTY OR ITEMS LEFT BEHIND Your Hummer will not be responsible for the loss of Your personal property brought in to the Vehicle either during the Hire Period or left in the Vehicle after the Hire Period by You or any other person.16. CUSTOMER CODE OF CONDUCT a. You must be at all times during the Hire Period available to be contacted by the Driver or My Hummer by mobile telephone. b. You and all other persons in the Vehicle must wear seat belts at all times. You agree to indemnify Us for any fines, costs or damages incurred should You or Your guests fail to wear a properly fastened seat belt when travelling in the Vehicle. c. You and all other persons in the Vehicle during the Hire Period are required to comply with any and all reasonable directions of the Driver at all times. d. You and all other persons in the Vehicle during the Hire Period are required to comply with the laws of Victoria. e. Should You or any other persons in the Vehicle engage in any illegal activity, anti-social behaviour, abuse of other road users, or other objectionable behaviour towards the Driver or members of the general public, the Driver may immediately terminate the Hire Period. We reserve the right to immediately terminate the Hire Period in the event of breach of this Clause and under such circumstances, the Total Booking Cost shall be forfeited. f. You agree that You will indemnify Us in relation to any act, loss, damage, suits or actions resulting from You or members of Your party or unrelated third parties, during the Hire Period.17. PERSONAL INFORMATION AND PRIVACY a. In accordance with its obligations under the Privacy Act 1988, Your Hummer will only collect personal information from You that is reasonably necessary for, or directly related to Your Booking. b. Your Hummer undertakes that any personal information collected from You for Your Booking will be reasonably protected and will not be disclosed for another purpose without the consent of You, unless otherwise required by law or required by these Terms and Conditions.18. ACKNOWLEDGEMENT AND INDEMNITY a. You indemnify Your Hummer and its officers, employees, affiliates and representative agents against all claims, damages, losses, costs and expenses incurred by You and/or any other member of Your party as a result of; i. any act or failure to act by the owners of the Vehicle or their employees, agents, representatives, or subcontractors, pursuant to these Terms and Conditions; ii. any action or failure to act by You and/or any member of their party pursuant to these Terms and Conditions. b. You agree not to take any action against Your Hummer for the result of any action or failure to act by the owners of the Vehicles or their employees, agents, representatives, agents or subcontractors.19. TERMINATION AND VARIATION We may terminate this agreement at Our discretion at any time, not later than fourteen (14) days prior to the Hire Date, and if We terminate this agreement, We will refund the Total Booking Fee to You, and We shall have no further liability under this agreement.
In this agreement the following definitions apply unless the context requires otherwise
‘The Company’ shall mean Mr President Limo Hire
‘Employee’ shall have the meaning of any employee of the company, including any driver or chauffeur employed by the company or agency contracted by the Company
‘Hirer’ shall be deemed to be the person who has signed the hire agreement and or the person responsible for the payment of the hire
‘Hire’ shall mean the period for which the vehicle has been hired or has been reserved for
‘Booking’ shall mean a period for which the hirer has committed to the hire and the full amount of the hire has been paid
‘Reservation’ shall been deemed to mean a hire where a deposit has been paid to hold the date, but the full amount has not been paid.
‘Vehicle’ shall mean any car or limousines supplied by the company to the hirer
'Deposit' shall mean the amount due under the terms of this agreement to secure a reservation
'Balance' shall mean the amount due under the terms of this agreement, less any deposits paid.
‘Party’ shall have the meaning person or persons accompanying the hirer as his or her guest or invitees
‘Chauffeur’ shall mean the driver of the vehicle
'Hire Charge' shall mean the amount due at any time under the terms of this agreement
1. All deposits are NON refundable.
2. Company is not liable in the event of mechanical breakdown while on charter. In the event that the vehicle is subject to an accident or mechanical failure, or is no longer safe to drive, then the company shall Endeavour to make alternative arrangements to get the hirers to their destination. The company may at its entire discretion determine the method of onward travel, alternatively the hirers may make alternative arrangements at their cost, for which no claim can be made against the company. The hirers specifically accepts that the hire is based on a best Endeavors basis and therefore, no specific guarantees can be made in terms of time, reliability of the vehicle and events out of the direct control of the Chauffeur or the company.
The client assumes full financial liability for any damage to the limousine caused during the duration of the rental by them or any members of their party. A fee of $200.00 for each carpet or seat burn. Sanitation fee is $250.00. Drug use is prohibited by law. The driver has the right to terminate run without refund (if there is blatant indiscretion on the part of the client's)). It is Illegal to stand through the sunroof. Smoking is not permitted in our limousines.
3. Overtime charges will apply after the scheduled booking time this will be calculated in 15 min. increments. This will include 5% admin fee
4. Not responsible for delays or the termination in winter caused by unsafe road conditions (i.e.. traffic, accidents, etc.).
5. Not responsible for articles left in the limousine.
6. Balances to be paid to the driver on the run date at the beginning of the run.
7. Vehicles cannot be loaded beyond seating capacity. By accepting to make this booking means that you have accepted all of these terms and conditions and the terms and conditions found on our website .All Deposits are no refundable.
Please note that the following will automatically be charged to your credit card and you will not be notified of these charges. The charges will incur a 5% fee.

The balance owing (if not paid in cash).
Any damage caused to the car, only to the extent that the damage was caused by the person booking or their guests.
Unnecessary mess that is left in the car will incur cleaning charges only to the extent that the mess was
caused by the person booking or their guests.
If the driver is delayed to his next job due to having to clean the car, you will be charged accordingly.
If you wish to cancel your booking and it is less than 6 weeks away your credit card will be charged the entire
amount owing. Cancellations must be made in writing and will only be considered cancelled after you have received confirmation from us.
Please also note:
Full monies are owed for the booking for any, cancellations that are requested less than 6 weeks from the intended hire date.
Change of times and dates may (at the discretion of Silver Service) incur an added administration fee.
When bookings are made less than 6 weeks from the booking the hirer accepts the responsibility of the "No Cancellation Policy" and full charges being made to the card .
These terms and conditions should only be accepted by a person of 18 years or older. And the Credit Card Holder. In accepting this confirmation you are accepting all of the above terms and conditions.
The Hirer shall be responsible for the proper behavior of all of the passengers and shall be primarily responsible for any damage caused to the vehicle howsoever caused. It is an express condition of the Hire that the Hirer accepts this responsibility.
The Hirer shall be fully responsible and liable for any damage caused both inside and outside the vehicle by the hirer or a member of his or her party, howsoever caused. This includes incitement or behavior resulting in damage to the vehicle or its contents by a third party.
The Hirer holds the Company harmless of any liability for any personal or material damages arising from the conduct of his or her party.
The Company shall not be held liable or responsible for any articles left in the vehicle and the Hirer specifically indemnifies the company from any such responsibility and undertakes to advise all other persons in his or her party.
9. General Conduct
The Hirer is responsible for the general conduct and behavior of his or her party.
The consumption of food is not permitted in any of the vehicles unless specific agreement has been made to the contrary at the time of the booking and agreed in writing.
Underage drinking is not permitted.
The Hirer accepts responsibility on behalf of the Hirer’s party for any losses of the property of the company that is provided in the limousine for the benefit or the pleasure of the passengers. This is includes, but is not limited to, glassware, CD’s, DVD’s, Video tapes and the like.
The Hirer accepts that the Company adopts a strict no smoking policy in all of its vehicles and that any failure to adhere to this policy will result in the immediate termination of this agreement without any refund. In addition to which, the Hirer shall be held responsible for the cost of a valet and any damage caused as a consequence of the Hirer of his or her party failing to adhere to this agreement.
It is a legal requirement that all passengers wear a seat belt where fitted. All of our vehicles are fitted with seat belts up to the maximum number of passengers allowed by law. Therefore, all passengers in the party are required to wear a seat belt. The Hirer specifically indemnifies the Company and the Chauffeur against any fines imposed as a consequence of the passengers failing to comply with this legal requirement.
The Company does not permit that taking of any illegal drugs or partaking of any illegal activities whilst in the vehicle, failure to abide by this condition will result in the immediate termination of the hire without compensation.
The Hirer expressly accepts that except in cases of an emergency, only the Chauffeur may open and close doors, this is a safety precaution to minimize the risk of accidents and damage to the vehicle. The Company will not be held responsible for accidents caused as a consequence of the Hirer or his or her party failing to adhere to this condition and the hirer accepts for responsibility for any damage to the vehicle and or any third party as a result of the Hirer or Hirer’s party failing to adhere to this condition.
The maximum number of passengers that can legally be carried in the vehicle is limited to the number of seat belts fitted, the Hirer expressly accepts this legal restriction and accepts that the chauffeur shall be required by the company to refuse to carry more than the statutory maximum. The hirer further accepts that failure to adhere to this road traffic regulation would likely result in the vehicle and its passengers being uninsured. In addition, the chauffeur and the company could be fined as a consequence. Therefore there will be no compromises on the safety issue.
Where the Hirer has asked for a child seat to be fitted, it is the responsibility of the Hirer to supply and ensure that the seat is correctly fitted before placing an infant into the seat. If the Hirer does not consider that the seat provides sufficient protection or that it is not fitted correctly, the Hirer shall not allow the infant to travel.
Irresponsible behavior which could give rise to damage to the Vehicle or endanger the safety of the other passengers will not be tolerated in any form. This includes, but is not restricted to; sitting on the exterior of the vehicle, hanging out of the windows, shouting abuse to other road users or pedestrians out of the window, rudeness or intolerance with the Chauffeur, misuse of the equipment, fixtures or consumable within the vehicle and willful damage to the interior generally. Such behavior may, at the sole discretion of the Chauffeur, the Company or its employees result in the immediate termination of the Hire without compensation. In addition, the Hirer shall be held liable and responsible for any loss, howsoever caused, by the irresponsible behavior of his or her party.
11. Limitation of liability
The Hirer accepts and indemnifies the Company and its employees against any loss, consequential or otherwise as a result, direct or otherwise of a failure to meet time deadlines. It is entirely the responsibility of the Hirer to ensure that there is adequate time to travel to and from destinations, the Company or its employees will provide advice, but this does not form any part of a contract between the Hirer, the Hirer’s party or the Company and its Employees.
Furthermore, the Hirer indemnifies the Company against any and all claims as a result, direct or otherwise, consequential or otherwise, of a failure to arrive at the destination at the appropriate time or at all.
The Hirer expressly accepts that in car entertainment such as television screens, video and DVD equipment is provided as a courtesy and its use and/or availability does not form part of the Hire. In the event that any equipment fitted to the Vehicle malfunctions prior to or during the hire, the Company accepts no liability whatsoever and no compensation shall be provided in such instances, nor will the Company accept any claims for any form of refund.
In the event that a vehicle is subject to an accident or mechanical failure, or is no longer safe to drive, then the company shall make alternative arrangements to get the Hirer and his or her party to their destination. The company may at its entire discretion determine the method of onward travel, alternatively the Hirer, or his or her party may make alternative arrangements at their cost, for which no claim can be made against the Company. The Hirer specifically accepts that the Hire is based on a best endeavors basis and therefore, no specific guarantees can be made in terms of time, reliability of the Vehicle and events out our of the direct control of the Chauffeur or the Company.
The Company assumes no responsibility nor does it provide any guarantees whatsoever for ensuring that the Hirer arrives at his or her destination on time. It is entirely the responsibility of the Hirer to determine whether the Vehicle has been hired for a period sufficient to cover eventualities such as, but not limited to, traffic accidents, roadwork's and peak traffic periods. In addition, the Hirer is responsible for ensuring that the Hire commences at a time which allows for such eventualities. The Company will not provide any refunds for such eventualities and any additional time over and above the Booking period shall be charged at the appropriate rate.
Where time is critical, this includes, but is not limited to Weddings, the Company recommends that the Hirer allows sufficient time to ensure that no disruption to the schedule is incurred as a result of unexpected or unavoidable delays.
Where the Company accepts responsibility whether in full or in part for a failure to perform its obligations under the terms of this contract then the extent of any liability shall be limited to the Hire Charge.
The Company reserves the right to change the specification of the vehicle at any time, provided that where the replacement vehicle is of a lesser value or specification, an appropriate adjustment is made in favor of the Hirer. The company undertakes to use its best endeavors to ensure that the Vehicle booked is the one provided for the hire.
Although the Company rarely does so, the Company reserves the right to sub-contract any Hire to a third party without reference to the Hirer, in such circumstances The Company shall be responsible for payment to the 3rd party of charges relating to the standard Hire. However, in the event that any additional services are provided, which include, but are not limited to, excess mileage, additional hours or damage to the Vehicle then the Company retains all rights to charge the Hirer
12. Payments and Deposits
To make a reservation the Hirer shall be required to pay a Deposit when making a reservation. The hirer may cancel up to 6 weeks prior to the booking and receive a full refund less deposits and admin charges. However, in the case of weddings and Special Events the period during which the hirer can cancel and receive a refund is extended to 8 Weeks, less deposits or 40% whichever is the greater.
The Hirer may elect to pay the full amount of the Hire at the time of making the reservation in order to confirm the booking. However, the Hirer accepts that once a booking is made to confirm the Hire, no refunds will be provided for any reasons whatsoever. That notwithstanding, the Company will consider at its sole discretion, claims for a partial refund where it can be demonstrated that the circumstances could not be seen by the Hirer and provided, in any event, that the cancellation or claim for a partial refund is at least 28 days prior to the date of the confirmed hire. In the case of weddings and special events hires, no refunds will be provided where the cancellation takes place less than 8 weeks from the date of the booking. In all cases where a cancellation is permitted, any refund will be provided after the deduction of administration charges for $50 or 20% which ever is greater for standard hires or $150 or 40% whichever is greater for wedding and Special Events hires.
The Company will not under any circumstances whatsoever, complete a hire where payment has not cleared on the due date, or in any event on the date of the hire. Cash paid must be paid at the commencement of hire and the client needs to sign the trip sheet in the possession of the driver
13. Additional charges
Time permitting; the Chauffeur may be willing to collect additional passengers, subject to the maximum that the Vehicle can carry, at alternative locations. However, any additional mileage or time shall be charged to the Hirer. Whilst the chauffeur will attempt to accommodate any last minute changes, the final decision will remain with the chauffeur and the hirer expressly accepts this arrangement.
In the event that the time or location of the hire is changed prior to the booking or at the time of the booking, the company expressly reserves the right to make any additional charges and to set such charges against the hirer’s deposit or credit card. Such charges will consist of an excess mileage charge and where the hire is extended beyond the agreed hire period, an hourly rate for each hour or part thereof. It is the Hirers responsibility to confirm with the Company or the Chauffeur current charges for additional hours and excess mileage, any failure to do so will not derogate the Hirers responsibility to pay the charges.
Where a Hire extends beyond the period of the Booking for whatever reason including, but not limited to traffic jams, accidents and diversions, the Hirer accepts that this additional time and mileage shall be charged to the Hirer's account.
In the event that the Vehicle has been left in an unreasonable condition by the Hirer or his or her party, then the Company reserves the right to charge for the cost of a valet. Such circumstances that could give rise to this charge include, but are not limited to; spillage of food or drinks and illness. The minimum cost of a valet is $185, but this amount could increase dependant on the consequential damage. The responsibility for reimbursement of such cost is that of the Hirer.
Additional charge of 5% being for credit card transactions and administration fees will be charged on any and all charges paid via credit card.
14. Other conditions
In the event that the Hirer is a business then that Company shall assume the responsibility of the Hirer and will be bound to advise the party or passengers of the terms and conditions of this Hire.
If any term or condition is found to be invalid for any reason whatsoever this shall not deem this agreement to be invalid and all other terms shall remain in force.
The Company may at its entire discretion refuse any Hire without explanation or reason.
Changes to cars, times or dates may incur a fee at the discretion of Mr President Limo Hire.”
